Prior to 2016, the use of stun guns in Texas was not regulated and as such, anyone could acquire and use the devices. The use of a stun device includes tasers, electric stun guns, electronic immobilization devices, electric shocking devices (other than for human implantation) or other device that is capable of incapacitating a person by the sending of a shock to the nervous system. The use of stun devices and tasers for example, are common in the police force, colleges, concert venues, riot control, bank guards, convenience stores, psychiatric wards, etc. Since 2016, however, the use of such devices is limited to the following: According to the law, a stun gun or taser must be advertised, used, manufactured, sold, and/or shipped using the states regulations or face criminal or civil prosecution.
The purpose of this update to the law was to ensure that the stun devices can only be used under those circumstances and on people who are over 18 years of age, and that the stun devices themselves do not cause any serious injury or death. As required by law, it is a criminal offense to manufacture, import, ship, sell or otherwise distribute a firearm or firearm accessory that does not comply with the regulations. Likewise, it is also a criminal offense to use a stun device in a manner that poses an imminent danger of death or serious injury to another person. Therefore, any commercial product using the stun technology and subject to these requirements must be manufactured to meet specific safety and quality guidelines. This means that even though the use of stun devices is now restricted to certain situations and individuals, the manufacturing of the devices still has to treat manufacturing in compliance with the law.
